PARKING LICENSE AGREEMENT

PLEASE READ IT CAREFULLY

GENERAL CONDITIONS PERTAINING TO ALL PERMITS

The Bay Area Rapid Transit (BART) system offers parking permits to patrons who utilize the BART system property and trains on a roundtrip basis. A BART patron is defined as one who proceeds directly into the BART station to ride the BART system train/s. All permits are and remain the property of BART and must be returned to BART’s vendor upon termination of parking privileges or upon demand by either an agent of BART and or BART’s vendor as the case may be. Should it be determined that the BART parking permit is being utilized for any other purpose then its intended and defined use, the permit may be revoked and the vehicle will be subject to citation. BART allocates a limited number of different permits (Monthly, Single Day and (APLT) Airport / Long Term) spaces at selected Stations with parking. These permits are offered on a first-come, first-serve basis.

When making any of these reservations it is important for you to carefully and correctly insert your license plate information or choose it from your account profile, as the reservation will then become associated with that license plate number and can only be validated by enforcement personnel if entered correctly. It also helps BART police in the event something should happen out of the ordinary requiring them to get in contact with you.

BART’s vendor and or agents are not authorized to make or allow any exceptions to this Agreement.  No employee may nullify or waive any terms of this Agreement.

PROOF OF PAYMENT

All patrons are required to display a valid parking permit through the front windshield of the vehicle with the permit facing outward and clearly displaying the permit number. Failure to display a valid permit may result in a citation or towing.

WAITLISTS (WHERE APPLICABLE)

Some stations have waiting lists pertaining to Monthly Permit Reservations and at times these lists can become lengthy and it could possibly be some time before you work your way up and through the list and eventually obtain a parking permit at the station of your choosing. You can observe and monitor your position on the waiting list within your profile once you have joined the waiting list at a given station. By monitoring your position on the list within your profile, you will be able to estimate the time it may take for your turn on the list to come up. There are additional and important steps you need to take to maintain your position on the list and they are as follows.

      1. Once you have joined a waitlist you will need to update and acknowledge your intention to remain on the list once every 180 days from the time of when you added your name to the list or updated your interest in remaining on it, thereby keeping your information current and up to date and acknowledging that you still desire to remain on the list. The list then refreshes and begins re-aging from the last point in time you completed this function.

        Clarification: This requirement is to serve the best interest of all patrons because at times and in some circumstances, wait list time frames can be lengthy and people for a number of reasons no longer wish or care to remain on the list. By example, this can be because individuals relocate or perhaps for some reason no longer ride the train. As the reservation system is designed to automatically notify people of their opportunity to park in a Station with a waitlist it is important the information on the waitlist be maintained accurately and up to date to avoid unnecessary delays for those patrons continuing to reside on it.

      2. As a matter of courtesy you will receive an email notifying and reminding you to acknowledge your position on the list and to check your information and update it within your profile approximately twenty days prior to when it is to be removed should you fail to acknowledge it. You should not however, rely solely on receiving this email as there are circumstances in which an email may not find its way through to you and as such, it would be best for you to also have an alternate means of reminding yourself of the need to do this prior to the 180 day period lapsing. The aging of the wait list is automatic and begins aging 180 days from every time that you acknowledge your desire to remain on the list, thereby allowing you to do it more frequently should you so desire to do so.


PAYMENTS & PAYMENT TERMS

Rates & Use - Permit rates vary by permit type and station under the terms and conditions as detailed herein. The on-line reservation system will detail the rates at the varying Stations for you prior to completing your reservation.

It is the sole responsibility of the patron to ensure that payments are made at a place, time, and in a form acceptable to BART. Payments that are declined for any reason whatsoever will be subject to an additional charge of $25. to cover the vendors additional handling expenses incurred with the rejection.

THERE ARE NO ADJUSTMENTS, DEDUCTIONS OR ALLOWANCES MADE TO THE PARKING FEES REGARDLESS OF IF THE PARKING IS USED, INCLUDING VACATIONS. IN ADDITION, IF THE PASS IS FORGOTTEN ON ANY GIVEN DAY, THE CUSTOMER IS SUBJECT TO PAYING THE REGULARLY POSTED DAILY RATE. A VALID PERMIT MUST BE DISPLAYED AT ALL TIMES WHILE PARKING ON BART PROPERTY.

Credit Card – When you choose to initially setup your profile through this on-line reservation system you are being asked to accept the terms and conditions as outlined in this agreement. Part of which is your agreement to allow us to hold your information in a secure environment and on file for the purpose of processing reservations of any type and permitted by this system either now or in the future. In so doing, charge to the credit card you provide for us and permit us to maintain within your profile, those costs associated with the reservations you choose to make within the system. While not limited to, those reservations are Single Day, (APLT) Airport / Long Term and Monthly Reserved permit types.

In the case of monthly parking permits, should your payment be declined when initially charged on the 15th of the preceding month for when payment is due, you will be notified by email at the email address you provided in your parking account that it has been declined. You will then have until the 25th of the month to make payment arrangements or adjustments to your credit card information. If your payment is again declined a second time, then you will receive notification that your parking has been terminated and you will be required to return the mirror hangtag to BART’s vendor.

BART reserves the right to suspend sales of parking permits to those patrons whom are having reoccurring rejections. Please see Monthly Permits for a definition of payment terms pertaining to this type of permit.

By mail - if sent to and received by our office 10 days in advance of the month for which payments are due.

In Person - By visiting the payment center during normal operating hours to make payment 10 days in advance of the month for which payments are due.

Our check processing policy includes:

  1. We can only accept individual Commuter Checks / WageWorks Checks / Tran Ben Checks made out to “Impark” and for an amount that is no greater than the exact correct amount for each month’s parking period.
  2. We cannot accept any payment unless it totals exactly the correct amount for the cost of one month of parking services. If your Commuter Check, WageWork Check or TranBen Check is in an amount for less than the cost for the designated parking period, then you must pay the difference with a personal check.
  3. All checks must clearly note the current and correct name, permit number and email address for the respective parking customer. Commuter Checks makes checks of two varieties: “Parking” and “Transit”. We can only accept those of type “Parking”.

 

CANCELLATIONS

Cancellations for APLT (Airport / Long Term) reservations are permitted so long as they are made prior to the commencement date of the reservation. A $10 cancellation fee will be assessed to cover the costs incurred by BART’s parking vendor for processing the credit and or refund. Single Day reservations are non-refundable because the cost of providing the refund would exceed the value of the refund itself.   

Monthly Permit Cancellations – In the case of Monthly Permit sales the patron agrees to give a thirty (30) day calendar “written” notice (Calendar – the 1st of any given month to the end of the month) of their intention to terminate their parking privileges so that BART's vendor may in turn re–license the parking permit to the next patron upon expiration of same. Such notice may be delivered in person or by mail to BART’s vendor as itemized above by no later than the 10th day of the preceding month or through use of the cancellation button associated with your account. Failure to do so will result in BART’s vendor charging the patron for continuous parking permits and those permits and associated payments are non-refundable. When submitting your cancellation, provide your full name, email address, contact telephone number and your permit number along with the name of the facility you are parking at and state that you would like to cancel your permit. You will receive confirmation of this notice once the vendor receives it and processes it.

PERMIT TYPES & POLICIES

Single Day Permit – When you use the on-line reservation system you may purchase a maximum of 10 Single Day permits. This permit allows you to park in designated areas throughout the day and does NOT allow overnight parking. These permits offer you a space to park in the stations permit/reserved areas up until 10:00am Monday through Friday. After 10:00am these permit/reserved areas are open to the general public and space cannot be reserved.

After 10:00am you may park anywhere in the station's other non-restricted parking areas on a space available basis utilizing your single day reserved parking permit.

Single Day permits are valid only for use throughout each day and do not permit vehicles to remain on BART property for periods in excess of 24 consecutive hours before becoming subject to citation and possibly towing for abandonment.

Single Day Reserved permits may be purchased no sooner than two months in advance of desired parking dates.

You will be required to printout a single day permit for each day of your reservation and display the permit through the front windshield of the vehicle with the permit facing outward and clearly displaying the permit number. Failure to display a valid permit may result in a citation or towing.

Patrons seeking a longer term permit should refer to the APLT / Long Term or Monthly parking permit programs. 

APLT (Airport / Long Term) – APLT (Airport / Long Term) Program permits can be purchased for periods of up to 30 days. These permits offer you a space to park in the stations permit/reserved areas up until 10:00am Monday through Friday. After 10:00am these permit/reserved areas are open to the general public and space cannot be reserved.

APLT permits may be purchased no sooner than two months in advance of desired parking dates.

Customers who purchase a long term parking permit may park in the station's permit/reserved or other areas that are non-restricted. This is the only permit that allows parking in excess of 24 consecutive hours and is subject to parking charges for weekends and holiday periods depending upon the start date and end date of the reservation and is as further explained below.

You will be required to printout your APLT (Airport / Long Term) permit for your reservation and display the permit through the front windshield of the vehicle with the permit facing outward and clearly displaying the permit number. Failure to display a valid permit may result in a citation or towing.

For security purposes, these permits will only display the date of the first day of the permit reservation and enforcement officers will verify the permit duration electronically.     

(APLT) Airport / Long Term 
Weekend and Holiday Exception:

APLT (Airport / Long Term) reservations beginning and ending on any weekday and spanning a BART designated Holiday, Saturday or Sunday are subject to daily parking charges throughout the on-line reservation including the BART designated Holiday, Saturday or Sunday covered throughout the reservation period. APLT (Airport / Long Term) reservations beginning or ending on a BART designated Holiday, a Saturday or Sunday are not charged for parking on that BART designated Holiday, Saturday or Sunday.

APLT (Airport / Long Term) permits are not available for purchase at any of the BART stations and can only be purchased online prior to arriving at the station. 

APLT (Airport / Long Term)
Consecutive Purchasing Prohibited 

APLT (Airport / Long Term) permits are the sole property of BART and may be rescinded at anytime. APLT (Airport / Long Term) permits are valid for up to a maximum of 30 days and cannot be purchased consecutively without the vehicle having left the premises for at least 72 hours. 

Monthly Parking Permit – You may purchase a monthly parking permit that allows you to utilize it for reoccurring daily use throughout the week at designated stations. These permits offer you a space to park in the stations permit/reserved areas up until 10 am Monday through Friday. After 10:00 am these permit/reserved areas are open to the general public and space cannot be reserved.

However, these permits do not allow for the vehicle to remain on BART property for any longer than 24 hours before they become subject to citation and possibly towing. For longer term permits please refer to APLT Airport / Long Term reservations.

The monthly parking permit allows parking at a designated station and it is offered on a calendar month basis, commencing on the first day of each month and continuing through to the last day of each month. 
The Monthly Parking Fee is due and payable in advance and must be paid by the close of business on the 25th day of the preceding month for which parking is due. Failure to make payment for parking privileges in advance of each month will result in any and possibly all of the following. Cancellation of Parking Privileges; Receiving a Citation; Paying the Daily Parking Rates as Offered On-line or at the Station to Avoid Citation and or Towing.

When initially purchasing your first Monthly Parking permit the purchase price is prorated based on the number of days remaining in the month of purchase.

A monthly parking permit (Mirror hangtag) for the facility will be issued at the time this Agreement is acknowledged and payment has been received for the first month’s rental. You will be charged $4.85 for the mirror hangtag plus your first months parking at the time of your first month’s reservation. Should the mirror hangtag become lost, stolen or damaged and require replacement, a replacement charge of $4.40 will also be required. Should your parking be terminated and or cancelled for any reason, this pass must be returned to BART’s vendor within 5 business days or you will be charged $10 for an unreturned pass.

When and if parking privileges have been terminated the space will be resold to the next person in line and where a wait-list exists, you will be subject to the rules and regulation governing wait-list procedures.
BART will provide a minimum of thirty (30) days’ calendar notice to Monthly Permit patrons of any rate adjustment or changes to parking rules and regulations.

Customers are required to contact Select-a-Spot by telephone to indicate a change in their automated monthly payment methods between the 1st and the 10th of any month. Changing payment methods outside of this window is not allowed.

Parking permits, waiting list positions and waiting list invitations are non-transferrable. Any transferred waiting list positions, waiting list invitations or parking reservations will be considered invalid and user accounts found in violation of this policy may be removed from the select-a-spot.com parking reservation system.

The Customer agrees to abide by all rules and regulations set forth in this Agreement.

This Agreement provides for the monthly parking privileges within the assigned facility only.  Patron agrees to hold BART and its parking vendor Select-a-Spot, and all their respective employees, officials, officers and agents (“Indemnified Parties”) harmless of any damages or injury, including, but not limited to, theft or damage to Patron's vehicle, or the contents thereof.  The Indemnified Parties do not guard or assume liability for the Patron's vehicle or its contents.  Patron fully RELEASES, WAIVES AND DISCHARGES forever any and all claims, demands, rights, and causes of action against and covenants not to sue the Indemnified Parties for any consequential and incidental damages.

This is the Full Contract of Bailment and we assume no liability for theft, collision, fire or damage in any case, except thru our own negligence, and then only to the extent of the retail used vehicle value of the bailed vehicle. We assume no liability for damage or injuries, occasioned by faulty brakes, by mechanical failure, or by your failure to set brakes properly and turn wheels sharply into curb on incoming drive. In case of damage, the bailor must demand repairs before vehicle is removed from facility, and upon demand we shall be entitled to make repairs ourselves or order same. In no case shall liability include anything for loss of use of vehicle. We reserve the right to remove or move vehicles and are not responsible for vehicles left after closing. We shall not be responsible for articles left in vehicles. No employee or agent may alter or enlarge our liability hereunder orally or otherwise. When requested, ignition key only is required to be left with car. DO NOT LEAVE TRUNK OR COMPARTMENT KEY. IF YOU MUST LEAVE VALUABLES IN YOUR VEHICLE LOCK THEM UP OUT OF SIGHT AND IN YOUR TRUNK. 

THIS CONSTITUTES THE ENTIRE CONTRACT AND ACCEPTANCE OF THIS CONTRACT CONSTITUTES ACKNOWLEDGEMENT BY THE HOLDER THAT HE OR SHE HAS READ AND AGREES TO THE FOREGOING.

VIOLATION OF POSTED RULES AND REGULATIONS THROUGHOUT THE FACILITY AND AS ARE CONTAINED HEREIN MAY RESULT IN VEHICLE TOWING AT OWNER’S EXPENSE.

THIS AGREEMENT MAY BE TERMINATED BY EITHER PARTY UPON THIRTY (30) DAYS’ CALENDAR WRITTEN NOTICE TO THE OTHER.

BART RESERVES THE RIGHT TO REFUSE THE SALE OF ANY TYPE OF PERMIT TO ANY PATRON.
